Smoke ban rebel appeals losing licence

Blackpool's controversial smoke ban rebel Hamish Howitt has appealed against losing his licence for breaking the national smoking ban.

Howitt, 54, of Park Road, is fighting the council's decision to revoke his licence for Delboys Sports Bar, on Rigby Road.

The licence was taken from Mr Howitt at a licencing panel hearing, on health and safety grounds and a weights and measures incident.

But Howitt, who has two bars on the same premises on Rigby Road, Delboys Sports Bar on the ground floor and Happy Scots Bar in the basement, believes the council have revoked the licence from the wrong bar.

Blackpool magistrates will hear Howitt's appeal on April 9.

The majority DO support an outright ban. Don't spout all that pro-smoking propaganda. I am sick of seeing that HSE report cited by pro-smokers. It doesn't prove anything. If you pro-smokers had any common sense you would know that ONE insignificant study proves no conclusive evidence of anything. There are many studies that have proven how damaging SHS really is. The ban is supported by non-smokers (THE MAJORITY!!!) and it is for the good of public health. At least now pubs are free from toxic fumes that taste of excrement.

Yes it is worth it. Now rates of smokers are dropping thankfully and so are rates of heart attacks. Also we have cleaner air free from toxic fumes. Pubs and clubs are not closing that is a myth. I know of many pubs and nightclubs in Blackpool that welcomed the ban and have prospered since its introduction.

I can understand CJ being pleased that he can visit smokefree pubs, but they were were becoming prevalent even before the ban, and if the ban were amended, most pubs, as he says, would remain smokefree. I don't understand why he needs every pub and cafe to be smoke free. I don't like loud music, but my tastes are taken care of by the free market. Perhaps you could comment CJ?

The first fair comment I have read on here jon. You do have a fair point. My strong stance against smoking stems from my job as a registered nurse where I all too well about the damage smoking does. Also from the fact I know people that have died because of smoking, meaning I want more health promotion to help people kick the habit. Also I support the ban from a public health point of view as I feel the human rights of bar staff are being breached by exposing them to toxic fumes.

CJ pubs closing is far from a myth. The Association of Licensed Multiple Retailers (ALMR) have just completed a National survey which shows that 10% (1200) community based pubs have closed in Britain since the various bans. With 3 months of volatile weather still to come this figure could substantially rise. You comment on Human Rights, what of the Human Rights of 14 million smokers and their 6 million or so tolerant non smoking friends. You may be interested to know that of some 300,000 workers in pubs about 90% are smokers themselves. They have been asked in National surveys and have by a massive 4 to 1 majority stated they did not want a ban. They rightly feared for their jobs, knowing full well the consequences of bans worldwide. So you are saying 20.29 million people should have their rights withdrawn for approximately 30'000 people who have indicated they are happy with a work place ban. I would suggest CJ that is not very democratic. As for the health risks per se, they are myths pure an simple as ASH themselves have admitted on more than one occasion. With such statements as 'it was necessary to create the illusion that ETS was harming others, especially children.' It may well be CJ you have fallen for that illusion but millions worldwide haven't which is why bans are being amended and rejected on a daily basis now.

CJ clais that soking rates have come down, I cannot disagree but they were on a downward trend before the ban. Tobacco sales have not reduced therefore I doubt that the ban has ade any significant change to the now standard rate of reduction seen over the past 10 years.

It should be about choice, nothing less, nothing more.

I dont see our great leaders, leading by example, it's do as I say, not do as I do.

Spain has a smoking ban, but it's a regulated ban which allows bars ect, to decide.Even in airports, there are smoking rooms.

I'm sick of reading all the comments from people claiming "ahh, my pub is smoke free, now I can smell the lavender", the problem is, there's only them in it !

Give people choice.

BTW, I dont smoke but, I'm sick of having a pint on my own !

As a smoker, my social life has been trashed. I see no reason why pubs and clubs should not have been allowed to have an indoor smoking room. No frills, just a big ashtray, a big fan in the wall and a strong spring on the door. I'd be interested to know if anyone is measuring the increase in cases of pneumonia and hypothermia, when you see all these scantily clad women stood out in the rain and wind on Blackpool promenade.

I'd be interested to know if anyone is measuring the increase in cases of pneumonia and hypothermia, when you see all these scantily clad women stood out in the rain and wind on Blackpool promenade.

We have the corrupt Brown regime, an unelected leader too follow an international war criminal, and a nation intent on division and to criminalise its citizens to disguise its own criminality. So paranoid it has to have spy cameras to spy on its own people, and create smoke militias to enforce its own corrupt practices, I am so disgusted with the low life that have taken over from the natural commonsense and freedoms that the ordinary British folk once had. Brown, Blair, the serious crimes committed in the UK are all attributable to you and your disgusting regime.
